Patents. Nothing good ever seems to come of them and just when we thought that the seven-year battle between Apple and Samsung, revolving around the latter’s infringement of the former’s patents was over it seems that this is, unfortunately, not the case.
Samsung has now rejected the final $533 million damages that were awarded against it, with a motion to have the verdict thrown now in the works.
Samsung, rather than simply wanting the amount reduced, has gone full bore on this one, demanding that a retrial be held as reported by Law360.
In Samsung Electronics Co. Ltd.’s 34-page post-trial motion, the Korean tech giant said the jury’s verdict, which awarded Apple Inc. about half of what it requested, wasn’t supported by the evidence and “no reasonable jury” could reach the jury’s conclusion.
“The jury’s verdict is excessive and against the weight of the evidence on each and every issue identified above, and … the evidence supports a verdict of no more than $28.085 million,” the motion said.
This obviously comes as little surprise after Samsung made its misgivings clear following the previous ruling, arguing that the “article of manufacturer” found to have infringed upon patents owned by Apple should have been specific to components themselves rather than the whole phone that they made up.
This would have meant a much smaller award against it, but on top of all this, Samsung is now also demanding that it is refunded a separate $145 million award in an unrelated case relating to the multi-touch technology used by Apple in its smartphones. As the patent was later invalidated, Samsung argues that Apple should be made to pay the money back.
Apple has until June 21st to respond with a hearing scheduled for July 26th.
